Terms and Conditions for the Arrangement of Motor Carrier

Introduction

Welcome to Web Auto Transport

These Terms and Conditions of Service (“Terms”) outline the agreement between you, the customer (“Customer”), and Web Auto Transport LLC (“Web Auto Transport”) concerning the arrangement of motor vehicle transportation services. By engaging with our services, you acknowledge and agree to these Terms. We reserve the right to update these Terms periodically, with changes becoming effective upon posting on our website at https://webautotransport.com/terms-and-conditions. Your continued use of our services signifies your acceptance of any revisions. In cases of conflict between these Terms and other documents, these Terms shall prevail.

Web Auto Transport LLC is fully licensed and bonded and holds active authorization as a property broker with the Federal Motor Carrier Safety Administration under MC-1820161.

1. Definitions

  1. Ancillary Services: Refer to supplementary services, such as temporary storage, requested by the Customer and facilitated by Web Auto Transport either before or after the primary transportation service.
  2. Bill of Lading: This official shipping document, potentially completed by the Customer, Carrier, or other authorized party, details essential shipment information such as weight, condition, and other relevant specifics.
  3. Bill to Party: Denotes the individual or entity designated on the Bill of Lading as the recipient of the invoice for the Shipment.
  4. Business Day: Refers to any day from Monday through Friday, between 8:00 AM and 5:00 PM, based on the local time zone of either the origin or destination, excluding U.S. federal holidays and weekends.
  5. Carrier/Motor Carrier: The individual or entity chosen by Web Auto Transport to execute the physical transportation of the Shipment. This entity operates under its own motor carrier authority and assumes liability for the transport.
  6. Consignor: Also known as the “shipper,” this refers to the person or entity from whom the Carrier is instructed by the Bill of Lading to pick up the Shipment.
  7. Consignee: The designated “ship to” party or entity to whom the Carrier is instructed by the Bill of Lading to deliver the Shipment.
  8. Customer or Shipper: Encompasses the individual or entity that has engaged Web Auto Transport to facilitate the movement of a Shipment, as well as any party directly benefiting from the services rendered under these Terms and Conditions.
  9. Customer Shipping Contract (CSC): This legally binding service agreement between the Customer and Web Auto Transport outlines the terms of service. Should the Customer make changes after the CSC is finalized, or if the CSC is not completed before the Customer’s specified First Available Date (FAD), the estimated pickup timeframe may be revised and an updated CSC will be issued.
  10. Double Booking: Occurs when a Customer arranges transportation for the same vehicle with multiple freight/property brokers. This practice disrupts the Broker’s ability to negotiate with motor carriers in good faith, causes mistrust among carriers, results in artificial rate increases, and causes unnecessary delays and costs for the Customer.
  11. First Available Date (FAD): The date provided by the Customer indicating when the vehicle will be ready for shipment. The Customer Shipping Contract (CSC) must be finalized before this date.
  12. Freight Broker/Property Transportation Broker/Broker: An entity licensed to arrange for the transportation of a Customer’s freight. Property brokers do not physically possess or transport property; instead, they act as intermediaries connecting Customers with motor carrier companies.
  13. Misrepresented Vehicle: Refers to a situation where the provided details (year, make, model, physical dimensions, modifications, or drivability/operability status) of a vehicle do not accurately reflect its actual description as supplied by the Customer.
  14. Order: Customer’s request for Web Auto Transport to arrange for the transportation of Customer’s Shipment.
  15. Parties: Collectively refers to the Customer, Consignee, Consignor, Web Auto Transport, and any other individual or entity with a current or prospective interest in the Shipment.
  16. Person: Denotes any individual, corporation, limited liability company, joint venture, trust, partnership, or other legal entity.
  17. Pickup Window: The estimated timeframe, typically between 1 to 5 business days following the Customer’s specified First Available Date (FAD).
  18. Remote Location: Any pickup or delivery address situated more than fifteen (15) miles from a major metropolitan area, interstate highway interchange, or other location accessible to standard open car carrier equipment, or any location requiring ferry, barge, or other specialized access. Orders requiring pickup or delivery at Remote Locations may experience extended or unavailable pickup windows and may be subject to additional fees.
  19. Restrictions: Any conditions or limitations imposed by the Customer on the pickup or delivery process, including but not limited to specific contact availability, designated dates or times, preferred trailer size or type, restricted business hours, inaccessible locations, or requirements for special documentation.
  20. Web Auto Transport: Refers to Web Auto Transport LLC, including its affiliated entities, employees, officers, directors, and agents.
  21. Shipment / Vehicle: Pertains to the cargo, typically a vehicle, detailed on the Bill of Lading and intended for transportation by the Carrier.
  22. Shipment Details: All information supplied by the Customer to arrange transportation, including contact details for pickup and delivery, specified origin and destination locations, and notification regarding any personal items within the vehicle.

By submitting a Shipment to Web Auto Transport for transportation arrangement, or by otherwise utilizing our services, the Customer agrees to be bound by the version of these Terms and Conditions in effect at the time of shipment tender. By signing the Customer Shipping Contract electronically, by submitting a vehicle for transport, or by making any payment, Customer agrees to be bound by these Terms and acknowledges having read them. Electronic signatures shall have the same legal force as handwritten signatures under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law.

These Terms will govern the Shipment, its transportation by the Carrier, and any Ancillary Services provided, and no agent or employee of any Party may alter them. In the event of any discrepancy between these Terms and a Bill of Lading or other shipping documents, these Terms shall take precedence. These Terms supersede any alleged oral agreements, promises, representations, or understandings between the Parties, unless explicitly stated otherwise in a separate written agreement.

Web Auto Transport’s broker services are deemed fully rendered upon the assignment and acceptance of a Motor Carrier to transport Customer’s Vehicle. No refund of the broker fee shall be due following such assignment, except as expressly provided in Section 8(e).

Customer represents that they are at least 18 years of age and have the legal authority to enter into this agreement. Customer further represents and warrants that Customer is the registered legal owner of the Vehicle, or has been duly authorized by the registered legal owner of the Vehicle to arrange transportation under these Terms.

3. Quotations

All freight and other service quotations provided by Web Auto Transport are valid for a period of seven (7) calendar days. The Customer acknowledges that these quotations represent estimated costs, derived from current marketplace pricing influenced by motor carrier/trucker availability. These estimates are subject to adjustment based on actual vehicle weight, make, model, condition, dimensions, and the number of vehicles being shipped, as well as unforeseen circumstances beyond Web Auto Transport’s control. The Customer understands that revised tariff quotations may be presented beyond the initial tariff due to dynamic pricing in the trucking market, and the decision to accept or decline such revised offers rests solely with the Customer.

4. Customer Responsibilities: Vehicle Preparation and Post-Transport Conditions

The Customer warrants that each Shipment is accurately classified and fully described on the Bill of Lading or any other relevant shipping documentation provided. Unless otherwise noted on the Bill of Lading, each Shipment is affirmed to be in good order and condition. The Customer further guarantees compliance with all applicable laws, rules, and regulations, including but not limited to customs, import, export, and Hazardous Materials laws.

  1. Vehicle Preparation: The Customer is responsible for preparing the Vehicle for transport by removing all loose components and fragile accessories, including but not limited to low-hanging spoilers. The Customer agrees to defend, indemnify, and hold harmless Web Auto Transport and the Carrier from any claims, damages, or losses resulting from parts of the Vehicle becoming detached or falling off during transport, including claims for damage to other property or personal injury.
  2. Removal of External Racks: All non-permanently affixed external racks, such as luggage or bicycle racks, must be removed from the Vehicle before transportation.
  3. Operable Vehicle Condition: Vehicles presented for transport must be in good working order and condition, unless otherwise specified. Fuel levels should be maintained between a quarter (1/4) and half (1/2) of a tank.
  4. Disarming Alarm Systems: Customers are required to disarm any vehicle alarm systems or provide clear instructions for doing so before transportation. Should an alarm activate without a key or instructions to deactivate it, the Carrier reserves the right to silence it by any available means. In such cases, neither Web Auto Transport nor the Carrier will be held liable for any resulting damage.
  5. Personal Property Liability: Pursuant to Federal Motor Carrier Safety Administration guidance and applicable federal transportation regulations, the Carrier is licensed to transport vehicles as freight, not household goods. Customer may place one suitcase or one small bag of personal items, not to exceed one hundred (100) pounds total, inside the vehicle solely as an accommodation. All personal property must be confined to the trunk or rear cargo area and may not obstruct visibility, exceed safe loading limits, or alter the vehicle’s declared transport classification. Customer must disclose the presence of any personal property prior to vehicle pickup and loading. Failure to disclose additional contents may result in refusal of service, reclassification fees, removal of items at pickup, or cancellation of the transport order. The Carrier reserves the right to refuse transport of personal property that: (i) violates federal, state, or local law; (ii) causes the vehicle to exceed legal weight limits; (iii) changes the commodity classification from “motor vehicle” to “household goods”; (iv) presents a safety hazard during loading, transit, or unloading. Customer acknowledges that motor carriers operating under auto transport authority are not licensed as household goods carriers and are not insured to transport personal household goods. Neither Web Auto Transport nor the Carrier shall be liable for loss, theft, or damage to any personal property placed inside the vehicle. Carrier cargo insurance covers the vehicle only and does not extend to personal contents. Any personal property left inside the vehicle is transported entirely at Customer’s sole risk. Vehicle damage resulting from excessive weight, shifting items, or improperly secured personal belongings shall be the sole responsibility of the Customer.
  6. Oversized and Inoperable Vehicles: Additional charges may apply for oversized vehicles, including but not limited to limousines, lifted vehicles, or those with dual or oversized wheels. If Web Auto Transport is not notified of an inoperable or oversized vehicle prior to pickup, any additional charges incurred must be paid directly to the Carrier in cash or money order before transportation commences. A minimum additional charge of two hundred and fifty dollars ($250.00) applies for any vehicle that is inoperable at the time of pickup and was not disclosed as such at the time of booking.
  7. Pre-trip Inspection: Before transportation, the Carrier and Customer will jointly inspect the Vehicle for any existing exterior damage, documenting findings on a vehicle inspection report as part of the Bill of Lading. Both parties will sign this report to confirm the Vehicle’s condition prior to transport. The Carrier’s responsibility for the Vehicle commences once this pre-trip inspection is completed and signed.
  8. Delivery: The Customer, or a designated agent, must be present at the time of delivery. Following transportation, the Carrier and Customer will conduct a joint inspection of the Vehicle. Signing the Bill of Lading without noting any damage confirms the Customer’s receipt of the Vehicle in good condition. The Carrier’s responsibility for the Vehicle concludes upon the Customer’s signature on the final Bill of Lading.
  9. CUSTOMER IS RESPONSIBLE FOR OBTAINING AND RETAINING A COPY OF THE SIGNED BILL OF LADING AT BOTH PICKUP AND DELIVERY. FAILURE TO RETAIN THE BILL OF LADING MAY IMPAIR CUSTOMER’S ABILITY TO FILE A DAMAGE CLAIM AND SHALL CONSTITUTE A WAIVER OF ANY CLAIM NOT NOTED THEREON.
  10. Toll Charges: The Customer is solely responsible for deactivating and/or removing any toll transponders from the Vehicle prior to transportation. The Customer agrees to release and indemnify Web Auto Transport and the Carrier from any toll charges incurred during the Vehicle’s transportation.
  11. Prohibited Personal Items: The Customer agrees to adhere to all local and federal regulations regarding prohibited personal items within the vehicle during transport. Explicitly forbidden loose personal items include, but are not limited to: hazardous materials, explosives, fireworks, combustible electronics or liquids, portable batteries and power banks (excluding factory-installed vehicle batteries and permanently installed components), controlled or illegal substances, medications, living or deceased plants or animals, food or perishables, ammunition, firearms, aerosols, high-value items, irreplaceable heirlooms, money, jewelry, art, televisions, electronic equipment not permanently installed in the vehicle, and time-sensitive legal documents.
  12. High-Value Vehicles: For vehicles with a market value exceeding $75,000, or for classic, exotic, collector, sports or modified vehicles, Web Auto Transport strongly recommends enclosed transport and the purchase of an independent cargo insurance rider. Open transport is provided at Customer’s risk for high-value vehicles. Web Auto Transport is not liable for market depreciation, diminished value claims, or cosmetic damage to high-value vehicles transported under open carrier arrangements. In addition, Web Auto Transport shall not be liable for loss of resale value, market fluctuation, or speculative damages.
  13. Address Changes: Any changes to the pickup or delivery address must be communicated to Web Auto Transport in writing at least forty-eight (48) hours prior to the scheduled pickup or delivery. Address changes made after Carrier dispatch may result in additional charges at the Carrier’s discretion, which shall be the Customer’s sole responsibility. Web Auto Transport assumes no liability for delays or failed deliveries resulting from Customer’s failure to provide timely address updates.
  14. California Residents: Under Cal. Civ. Code § 1789.3, California residents have the right to file complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs (DCA), in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, by phone at (916) 445-1254 or (800) 952-5210, or by email at dca@dca.ca.gov.

5. Independent Contractor Status

Web Auto Transport is a federally licensed Property Broker under 49 U.S.C. §13102(2) and 49 CFR Part 371, authorized to arrange, but not to perform, the physical transportation of motor vehicles. Web Auto Transport operates solely as an independent intermediary and does not act as an agent, employee, or representative of either the Customer or any Motor Carrier engaged to perform transportation services. No agency relationship, express or implied, is created between Web Auto Transport and any Motor Carrier by virtue of these Terms or any transportation arrangement made hereunder. Motor Carriers engaged by Web Auto Transport perform transportation services as independent contractors operating under their own federal authority, equipment, and insurance. Customer acknowledges that Web Auto Transport has disclosed its status as a property broker prior to Customer’s agreement to these Terms and that Customer has not been induced to believe that Web Auto Transport is a Motor Carrier performing physical transportation services.

Customer further acknowledges that Web Auto Transport retains no operational control over any part of the transportation of the Vehicle once tendered to the assigned Motor Carrier. Web Auto Transport has no right to order delivery stopped or resumed for any reason, no right to inspect the Vehicle or receive progress reports during transit, and no right to direct, supervise, or otherwise control the Carrier’s equipment, personnel, or operational decisions. The Customer and Web Auto Transport hereby acknowledge that Web Auto Transport takes no active role in ensuring safety during the physical transportation of the Vehicle.

6. Carrier Selection; Limitation of Liability for Carrier Acts

Web Auto Transport performs commercially reasonable due diligence in verifying that carriers hold active FMCSA operating authority, required insurance coverage, and satisfactory safety ratings at the time of carrier selection.

Each Carrier contracted by Web Auto Transport shall maintain active FMCSA operating authority, public liability insurance of not less than seven hundred fifty thousand dollars ($750,000), and cargo insurance of not less than one hundred thousand dollars ($100,000) per shipment, unless otherwise disclosed in writing. Web Auto Transport verifies Carrier insurance and authority through the Federal Motor Carrier Safety Administration's public database at the time of dispatch but does not audit, warrant, or guarantee the sufficiency, validity, or coverage of any Carrier policy. Web Auto Transport also utilizes industry-standard carrier verification and identity validation tools prior to dispatch.

Customer acknowledges that Web Auto Transport does not guarantee carrier performance and shall not be liable for claims arising from the acts, omissions, or negligence of selected Motor Carriers beyond such reasonable verification.

Web Auto Transport’s aggregate liability to Customer for any claim arising from or related to broker services shall not exceed the broker fee actually paid by Customer to Web Auto Transport for the specific shipment giving rise to the claim.

Customers seeking additional protection beyond Carrier cargo insurance may purchase TransitShield, an optional Shipper's Interest Transit Insurance product, as described in Section 12(d). Web Auto Transport recommends TransitShield for all vehicles with a market value exceeding fifty thousand dollars ($50,000).

7. Waiver

Should either party fail to enforce any provision of these Terms and Conditions, or neglect to exercise any right or privilege herein, or waive any breach of these terms, such action shall not be construed as a subsequent waiver of those terms, conditions, provisions, rights, or privileges. All such elements shall remain in full force and effect as if no such forbearance or waiver had taken place.

8. Payment Terms, Deposit, Fees, and Refund

a. Deposit and Balance Payment: For all shipments, the deposit becomes due and payable to Web Auto Transport upon assigning a Motor Carrier to pick up the Vehicle. The Customer authorizes Web Auto Transport to verify their credit/debit card details once the Customer Shipping Contract is electronically signed.

Full-Payment Orders: For full-payment orders totaling $2,000 or more, payment must be made via ACH/eCheck, bank wire transfer, or certified check. Credit card payments are not accepted for full-payment orders exceeding $2,000. The Customer authorizes Web Auto Transport to process ACH/eCheck payments when selected through our secure payment gateway.

Cash-on-Delivery Orders (COD): For cash-on-delivery orders, the deposit may be paid by credit card regardless of total shipment value. Any remaining balances due upon the Carrier's arrival for vehicle delivery must be paid directly to the Carrier in cash, cashier's check, or money order made payable to the Carrier. Personal checks or credit cards are NOT accepted for the remaining balance paid to the Carrier, unless otherwise agreed in writing.

Chargebacks or payment reversals are prohibited for completed services or shipments where a Carrier has been assigned. Failure to pay the Carrier the remaining balance at delivery may result in the Vehicle being placed in storage and subject to the Carrier's statutory lien, with all storage, lien, and redelivery charges being the sole responsibility of the Customer.

All fees due must be paid in full when due and are not subject to dispute or offset for any damages or any other reason (including, without limitation, because Customer is not satisfied with the Services). Once paid, fees are non-refundable. If Shipment is placed in storage due to Customer’s refusal to pay the fees or accept delivery from the Carrier for any reason, then the Shipment may be placed in storage at Customer’s expense and subject to Carrier’s lien for transportation charges until Customer pays in full the outstanding balance. Any and all storage and redelivery charges will be the responsibility of Customer and Customer agrees that Customer will not look to Web Auto Transport for reimbursement.

b. Cancellation: Customer may cancel an Order at no cost as long as the Order has not yet been accepted by a Carrier. A cancellation fee of two hundred and fifty dollars ($250) applies if the Order is canceled after a Carrier has accepted the Order. This fee compensates Web Auto Transport for services rendered, including carrier vetting, rate negotiation, dispatch coordination, and the Carrier’s reserved truck space. The $250 cancellation fee applies under the following specific circumstances:

  • Customer cancels the order after carrier assignment for any reason, including double-booking with other broker companies.
  • Vehicle description was misrepresented or inaccurate shipment details were provided by the Customer.
  • Customer-imposed restrictions or payment issues cause delays or prevent pickup within the estimated pickup window.
  • Customer fails to complete the Customer Shipping Contract (CSC) before the First Available Date.

To be valid, all cancellation requests must be submitted in writing to info@webautotransport.com. Web Auto Transport will not accept cancellation requests made via telephone, text, LiveChat, or any other medium. Any non-refundable deposits may be applied towards a new shipment within three (3) months from the date the original order was canceled. Web Auto Transport reserves the right to cancel any order at its discretion.

In the event a Motor Carrier arrives at the designated pickup location within the scheduled pickup window and is unable to load the Vehicle due to Customer unavailability, vehicle unreadiness, or misrepresentation of vehicle details, a dry run fee of two hundred dollars ($200.00) shall apply and is payable by Customer to Web Auto Transport in addition to any applicable cancellation fees.

In the event that the Customer requires a change to the pickup window after a Motor Carrier has already been assigned to the transport, a rescheduling fee of one hundred and fifty dollars ($150.00) may apply. Upon rescheduling, the original pickup window is voided, and a new window will be determined based on carrier availability at prevailing market conditions.

Prior to releasing the Vehicle to the assigned Carrier at the time of pickup, Customer retains the right to refuse the selected Carrier and request that Web Auto Transport assign an alternative. Upon Customer’s release of the Vehicle to the assigned Carrier, Customer acknowledges their approval of the selected Carrier and confirms that Web Auto Transport’s broker services have been fully rendered for that shipment.

c. Web Auto Transport's Right to Cancel

Web Auto Transport reserves the right to cancel any Order at any time, with or without cause, in its sole discretion.

We may cancel an Order immediately and without prior notice for reasons including but not limited to:

  • Abusive, threatening, or harassing conduct toward our staff, carriers, or contractors;
  • Use of profane, discriminatory, or intimidating language;
  • Repeated unreasonable contact or demands that disrupt business operations;
  • Bad faith conduct, including knowingly providing false or misleading information about the vehicle, pickup/delivery locations, or shipment details;
  • Refusal to comply with our policies, Terms and Conditions, or reasonable instructions from our staff;
  • Chargeback abuse, including threats to initiate chargebacks or disputes as leverage for demands unrelated to legitimate service failures;
  • Payment disputes, including refusal to pay agreed-upon amounts or balance due to carriers;
  • Conduct that creates legal, safety, reputational, or operational risks for Web Auto Transport, our staff, carriers, or other customers;
  • Any violation of these Terms and Conditions.

When Web Auto Transport cancels an Order for any of the above reasons, the Cancellation Fee set forth in Section 8(b) shall apply, and Web Auto Transport may withhold, reduce, or offset any refunds to cover costs incurred, including staff time, carrier coordination, and administrative expenses.

If cancellation occurs after a Carrier has been assigned, the Customer remains responsible for any carrier cancellation fees or charges imposed by the Carrier, in addition to Web Auto Transport's Cancellation Fee.

This right to cancel is in addition to, and does not limit, any other rights or remedies available to Web Auto Transport under these Terms or applicable law.

d. Past-due Invoices: Past-due invoices are subject to a service charge at the lesser of (i) two percent (2%) per month or (ii) the highest legal rate authorized by applicable law. The Customer is responsible for all charges associated with their shipment, including transportation fees, fuel surcharges, and any additional accessorial charges. The Customer further agrees to cover Web Auto Transport’s reasonable attorney fees and legal costs incurred in connection with any related disputes.

e. Lien and Adjustment of Charges: Web Auto Transport holds a lien on the Shipment for all outstanding amounts related to this Shipment, subordinate to any statutory lien held by the Motor Carrier under 49 U.S.C. §80110 and applicable federal transportation law. Web Auto Transport reserves the right to modify or adjust the initial quoted amount if the original quote was based on inaccurate information provided by the Customer.

f. Refunds: Customer is entitled to a refund for only the unfulfilled portion of the services. Web Auto Transport will refund all payments if a written cancellation and refund request is sent by Customer before a Carrier has accepted the Order. Refunds will also be issued if a written cancellation is received before pickup due to an increase in the quoted tariff. No refunds will be issued after a Carrier has been assigned, or if the Carrier is unable to pick up the vehicle due to the Customer’s failure to provide accurate information, vehicle unavailability, or other reasons attributable to the Customer.

g. RateShield - 30-Day Price Lock Guarantee: Upon confirmation of the Customer’s Order, the transport price shall be protected for thirty (30) calendar days from the date of booking (the “RateShield Period”), subject to the following terms.

IMPORTANT DISCLOSURE: The RateShield guarantee does not constitute a warranty or guarantee of carrier assignment within the RateShield Period. Web Auto Transport reserves the right to withdraw or modify the RateShield guarantee if any eligibility condition is not satisfied. Force majeure events automatically suspend RateShield obligations.

If Web Auto Transport assigns a Motor Carrier whose total transport fee exceeds the original price during the RateShield Period, Web Auto Transport may, at its sole discretion, subsidize the difference in an amount not to exceed three hundred dollars ($300.00) per vehicle (the “RateShield Subsidy”), provided all of the following conditions are met:

  • No Order Modifications: The Customer has not made any changes to the Order after initial confirmation.
  • Accurate Information: All information provided at booking is accurate, complete, and truthful.
  • Exclusive Listing: The vehicle has not been listed with any other broker, marketplace, carrier or transport provider during the RateShield Period.
  • Timely Vehicle Availability: The vehicle is fully accessible for pickup within thirty (30) days of the booking date.

The RateShield Price Lock Guarantee shall be rendered null and void upon the occurrence of any material change, including but not limited to:

  • Inaccurate vehicle specifications;
  • Vehicles determined to be non-operational (INOP) or requiring specialized equipment not disclosed at booking;
  • Pickup or delivery locations deemed Remote Locations per Section 1(r);
  • Changes to pickup or delivery addresses;
  • Alterations to the requested trailer type;
  • Modifications to the first available date (FAD); or changes to payment method or timing.

The RateShield guarantee is limited solely to the subsidization of increased carrier pricing up to the stated maximum and does not cover ancillary fees, surcharges, or services not included in the original quote.

RateShield does not apply in the event of significant market disruptions beyond Web Auto Transport’s control, including but not limited to:

  • Sharp increases in fuel prices
  • Geopolitical events or conflicts affecting transportation markets
  • Natural disasters or extreme weather events
  • Nationwide or regional carrier capacity shortages
  • Government actions, regulatory changes, public health emergencies, or other governmental orders.

In such cases, Web Auto Transport reserves the right to (i) adjust the quoted transport price to reflect current market conditions, (ii) suspend or withdraw RateShield protection, or (iii) offer revised pricing for Customer's approval prior to dispatch.

Expiration of the RateShield Period. If Web Auto Transport is unable to assign a Motor Carrier within the thirty (30) day RateShield Period, Customer may elect to (i) extend the booking at the then-current market rate, or (ii) cancel the Order with a full refund of any deposit paid, notwithstanding Section 8(b). Customer must communicate this election in writing to info@webautotransport.com within seven (7) calendar days following the expiration of the RateShield Period. If Customer does not communicate an election within this window, the Order shall be deemed extended at the then-current market rate.

9. Bills of Lading

All Bills of Lading are non-negotiable. Any inclusion of Web Auto Transport’s name on the Bill of Lading by the Customer or any other party is solely for administrative convenience and does not alter Web Auto Transport’s role as a property broker. Web Auto Transport does not assume the responsibilities of a freight carrier and acts exclusively as a transportation broker arranging for motor carriers to transport the Customer’s freight.

Customer authorizes Web Auto Transport to negotiate and enter into contracts with Motor Carriers that may include terms limiting the Carrier’s liability for loss or damage to Customer’s freight. Customer understands and agrees that it will be bound by such limitations of liability.

10. Pickup and Delivery Locations

The Carrier will pick up and deliver the Vehicle as close to the Customer/Consignee’s location as legally and safely possible. An alternative loading or unloading location may be required due to obstacles such as low-hanging trees, overhead wires, narrow roads, or local restrictions in residential and city areas. The Carrier may change the pickup and/or delivery location if it determines such change is necessary for the safe loading or unloading of the Vehicle. The Customer agrees that Web Auto Transport is not liable for any loss, damage, or delay caused by Carrier location adjustments deemed necessary for the safe loading/unloading of the vehicle. Pickup and delivery at Remote Locations (as defined in Section 1(r)) may be subject to extended windows and additional surcharges.

11. Indemnification

Customer agrees to indemnify, defend, and hold harmless Web Auto Transport, its officers, directors, employees, agents, and affiliates, from and against any and all losses, liabilities, damages, claims, suits, actions, judgments, penalties, fines, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of, resulting from, or relating to:

  • The acts or omissions of the Customer, its agents, employees, or representatives;
  • The loading, unloading, transportation, or delivery of any vehicle arranged through Broker;
  • Customer’s breach of this Agreement, misrepresentation, or violation of law; or
  • Claims by any third party, including Motor Carriers, shippers, consignees, or governmental authorities, relating to the services arranged by Broker.

This indemnification includes, without limitation, claims for bodily injury, death, property damage, cargo loss, theft, delay, or environmental harm.

12. Loss, Damage or Delay Claims

Web Auto Transport LLC is a federally licensed Property Broker with MC-1820161 under 49 U.S.C. §13904 and 49 CFR Part 371. Property Broker is not a Motor Carrier or freight forwarder and does not assume responsibility for the actual transportation, custody, possession, or control of the Customer’s vehicle(s) or property. Property Broker’s role is limited exclusively to arranging transportation with authorized Motor Carriers.

Federal transportation law, specifically the Carmack Amendment (49 U.S.C. §14706), governs loss, damage, and delay claims against Motor Carriers, not Property Brokers. Accordingly, Web Auto Transport shall not be held liable for any cargo loss, theft, damage, delay, or accident occurring during transportation.

Customer agrees that all claims for freight loss, theft, damage, accidents, delay, or bodily injury must be filed directly with the assigned Motor Carrier, not with Web Auto Transport. Web Auto Transport may, at its sole discretion and as a courtesy only, assist the Customer in facilitating communication between the Customer and the Motor Carrier regarding such claims, but assumes no liability for claim outcomes, payments, or denials.

Customer understands and agrees that general cargo insurance exclusions commonly apply for losses or damages caused by: stand-alone mechanical or electrical issues of any kind (including engine, transmission, drivetrain, wiring, cooling systems, power steering, air bags, braking system, and computerized systems); unseen or uninspected undercarriage areas; pre-existing loose or broken parts; damage to convertible, vinyl, or fabric tops; damage to antennas, roof racks, or aftermarket accessories; scratches or chips caused by road debris or objects from other vehicles; tire or rim damage; damage to plastic bumper components caused by curb contact; non-stock audio or video equipment; damage caused by failure of factory tie-down points; the vehicle’s interior (floormats, odors, seating, fabric); personal items left in the vehicle; toll charges; and weather conditions including hail, storm, or other acts of God, riots, strikes, political unrest, or acts of terrorism. Neither Web Auto Transport nor the Carrier is liable for any cargo loss or damage caused by acts or omissions beyond their control.

a. Damage/Freight Claims Procedure: All freight claims should be submitted no later than forty-eight (48) hours after delivery to Web Auto Transport. Web Auto Transport will acknowledge receipt of a damage or loss claim within three (3) business days and will provide an initial response or referral to the Motor Carrier within ten (10) business days of claim submission.

If the loss or damage is apparent, the Consignee must note such loss or damage on the Bill of Lading at delivery. If the loss or damage is concealed (not apparent at delivery), the Customer or Consignee must contact Web Auto Transport within five (5) business days after taking delivery. The filing of a freight claim does not relieve Customer of its obligation to pay all freight charges when due.

To be considered for processing, all damage claims must include: (i) written notation of the damage on the Bill of Lading at delivery; (ii) photographic evidence of the damage taken at or immediately following delivery; and (iii) at least one written repair estimate from a licensed repair facility. Claims submitted without this documentation may be denied as procedurally deficient.

Web Auto Transport, Carrier, and/or Carrier’s insurer shall have the right to inspect the Vehicle at the location where the Vehicle was delivered. The failure to permit or arrange an inspection as required herein, or the failure to give timely notice of any loss or damage in accordance with this Section 12(a), shall constitute an absolute bar to recovery for any claim for loss or damage. Customer may not offset damage claims or any other amounts from the deposit or freight charges owed to Web Auto Transport or Carrier.

b. No Liability for Damage to Vehicle: As a Property Broker, Web Auto Transport has no liability for loss, delay, or damage to the freight. The customer’s sole remedy for loss of, non-delivery, or damage to the Vehicle is against the Motor Carrier. Web Auto Transport is not liable for any loss, damage, late delivery, non-delivery, or consequential damages caused by the act, default, or omission of (1) the Carrier, (2) the Customer, or (3) any other party who claims an interest in the shipment. Neither Web Auto Transport nor the Carrier provides compensation for loss of use of the Vehicle nor reimbursement for rental vehicles as a result of damage to the Vehicle.

c. No Consequential Damages:

IN NO EVENT SHALL WEB AUTO TRANSPORT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS OR LOSS OF MARKET, LOSS OF INCOME, ATTORNEY’S FEES, PUNITIVE DAMAGES, WRONG DELIVERY, OR DAMAGE TO PROPERTY, DELAYED DELIVERY OR FAILURE TO ATTEMPT DELIVERY, WHETHER OR NOT WEB AUTO TRANSPORT HAD KNOWLEDGE THAT SUCH DAMAGES OR LOSSES MIGHT OCCUR.

d. Insurance: Web Auto Transport strongly recommends that Customer obtain independent cargo insurance for the shipment.

Optional Transit Insurance (TransitShield). Web Auto Transport makes available to Customers an optional Shipper’s Interest Transit Insurance product marketed as TransitShield (“Transit Insurance”). The following terms apply to any Customer who elects to purchase TransitShield:

(i) Elective Add-On. TransitShield is an optional add-on available at the time of booking for a flat fee of $99 per vehicle. It is not included automatically in the transport price and does not form part of the standard services provided by Web Auto Transport. The Carrier’s cargo insurance remains the primary coverage on every shipment, regardless of whether TransitShield is purchased.

(ii) Facilitation Only. Web Auto Transport facilitates Customer access to TransitShield through Tint Embedded Insurance Services, LLC (“Tint”). The underlying insurance is underwritten by R.V.I. Guaranty Co., Ltd. under the TrustedTransport Shipper’s Interest Insurance Policy (the “Tint Policy”). Web Auto Transport is not an insurer, is not a party to the Tint Policy, and accepts no liability whatsoever for coverage determinations, claim approvals, claim denials, or claim payments made under the Tint Policy.

(iii) Governing Terms. All coverage terms, conditions, exclusions, limitations, and claim procedures applicable to TransitShield are governed exclusively by the Tint Policy. In the event of any conflict between these Terms and Conditions and the Tint Policy, the Tint Policy shall control with respect to all insurance coverage matters.

(iv) Customer as Loss Payee. When a Customer purchases TransitShield, the Customer is designated as the Loss Payee under the Tint Policy. Web Auto Transport is the Covered Shipper. All claims must be submitted directly to Tint Embedded Insurance Services, LLC at support@tint.ai or (909) 505-2338, within seven (7) days of discovering any loss or damage. TransitShield insurance claims submitted directly to Tint pursuant to this subsection are not subject to the Claims Communications requirements of Section f., Claims Communications of these Terms and Conditions.

(v) Coverage Limitations. TransitShield covers eligible vehicles with an actual cash value not exceeding $200,000. Eligible vehicle types are limited to cars, trucks, SUVs, and vans (operable or inoperable). Motorcycles, recreational vehicles (RVs), trailers, mobile homes, boats, and watercraft are not eligible. Personal items, loose goods, or unsecured items inside the vehicle are not covered. Pre-existing damage, extreme weather events (including hurricanes, tornadoes, floods, earthquakes, wildfires, and named storms), electrical or mechanical breakdown (unless caused by an insured peril), and diminished value are not covered. The per-vehicle maximum limit is $200,000 with a $100 deductible per claim.

(vi) Cancellation. A Customer may cancel TransitShield coverage at any time prior to the commencement of Transit (as defined in the Tint Policy) for a full refund of the $99 fee. No cancellation is permitted after Transit has commenced.

(vii) Photographic Documentation. As a condition precedent to coverage under the Tint Policy, the Customer or its designee must take and retain clear, date- and time-stamped photographs of all sides of the vehicle prior to shipment and upon delivery at the destination. Failure to provide such documentation may result in denial of coverage.

(viii) Jurisdictional Note. Disputes arising under the Tint Policy are subject to the exclusive jurisdiction of the courts of New York, New York, as provided in the Tint Policy, which governs notwithstanding any other choice-of-law or venue provision in these Terms and Conditions.

Web Auto Transport is not obligated to provide cargo insurance and is not legally liable for any loss, damage, or delay of freight. Carrier insurance information will be provided to the Customer upon request.

e. Claims Communications:

All standard claim communications may be submitted by email to info@webautotransport.com. However, ALL FORMAL LEGAL NOTICES AND INSTRUMENTS TENDERED AS FULL OR PARTIAL SATISFACTION OF A DISPUTED DEBT must be sent in writing by certified mail to: Web Auto Transport LLC, 8716 W Northview St, Boise, Idaho 83704. Communications sent only by email will not constitute formal notice for purposes of accord and satisfaction or legal dispute resolution.

13. Mandatory Arbitration; Governing Law; Forum Selection

IMPORTANT NOTICE: These Terms contain a mandatory arbitration clause, jury trial waiver, and class action waiver. These provisions require Customer to submit claims against Web Auto Transport to binding and final individual arbitration, not as a plaintiff or class member in any class, group, or representative action or proceeding. Please read Section 13 carefully.

  1. Good Faith Resolution. Web Auto Transport and Customer will attempt to resolve in good faith any claim, controversy, or dispute arising out of or relating to these Terms or the services provided through consultation and negotiation in a spirit of mutual cooperation. Both parties agree to make reasonable efforts to correspond and attempt to resolve any such dispute before resorting to arbitration.
  2. Pre-Arbitration Notice Requirement. At least thirty (30) days before beginning an arbitration proceeding, the party seeking arbitration must send an individualized written notice, personally signed, identifying the party, its legal claims, the specific relief requested, and the intent to pursue arbitration. Such notice must be sent by certified mail, Federal Express, UPS, or USPS Express Mail (signature required) to: Web Auto Transport LLC, 8716 W Northview St, Boise, Idaho 83704. If Web Auto Transport initiates arbitration, it will send such notice to Customer at the last known mailing address or, if no physical address is available, by electronic mail to the last known email address.
  3. Binding Arbitration; Federal Arbitration Act. If the parties are unable to resolve the dispute within thirty (30) days of the pre-arbitration notice, either party may pursue binding arbitration. The Federal Arbitration Act and federal arbitration law govern this arbitration provision and its interpretation. Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided by Web Auto Transport shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes, as applicable. The arbitration shall be conducted before a single, neutral arbitrator selected in accordance with the AAA’s rules. The parties agree to delegate the issue of arbitrability to the arbitrator. There shall be no judge or jury in arbitration; however, the arbitrator shall have authority to award the same damages and relief that a court could, including injunctive and declaratory relief or statutory damages where applicable. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
  4. Small Claims and IP Exceptions. Either party may assert claims in small claims court if the claim qualifies under that court’s jurisdictional limits. Either party may also bring suit in any court of competent jurisdiction to enjoin infringement or misuse of intellectual property rights, including to seek temporary restraining orders or injunctive relief, without first complying with the pre-arbitration notice requirement. Either party may additionally seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
  5. Arbitration Fees. Payment of AAA filing, administrative, and arbitrator fees shall be governed by the AAA’s Consumer Arbitration Rules, except as follows: for disputes in which the amount in controversy is less than $10,000, Web Auto Transport shall advance all AAA filing and administration fees on Customer’s behalf, subject to reallocation by the arbitrator in the final award. If Customer is the prevailing party, Customer may seek reimbursement of reasonable fees and costs from Web Auto Transport. If Web Auto Transport is the prevailing party, it may seek reimbursement of its reasonable attorneys’ fees and costs if the arbitrator determines that Customer’s claims were frivolous or brought in bad faith.
  6. Class Action Waiver.

ALL CLAIMS AND DISPUTES SUBJECT TO ARBITRATION UNDER THESE TERMS MUST BE ARBITRATED ON AN INDIVIDUAL BASIS ONLY. NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, NOR MAY ANY CLAIMS BE CONSOLIDATED OR ARBITRATED TOGETHER WITH THOSE OF OTHER CUSTOMERS OR THIRD PARTIES. ONLY INDIVIDUAL RELIEF IS AVAILABLE. If a court of competent jurisdiction or the arbitrator determines that applicable law precludes enforcement of any portion of this class action waiver with respect to a particular claim, then that claim, and only that claim, shall be severed from arbitration and may proceed in a court of competent jurisdiction in Ada County, Idaho. All other claims shall remain subject to binding individual arbitration.

g. Jury Trial Waiver.

TO THE EXTENT ANY CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION FOR ANY REASON, WEB AUTO TRANSPORT AND CUSTOMER EACH IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY.

h. Confidentiality. Any arbitration proceedings, related communications, and the arbitration award shall remain strictly confidential between the parties. Neither party shall disclose the existence, content, or results of any arbitration without the prior written consent of the other party, except as required by law or to enforce the arbitration award.

i. Statute of Limitations; Survival. All claims and disputes must be filed within three (3) years of the date the dispute arose, or they are permanently waived. If multiple disputes arise regarding the same or substantially similar issues, the claims shall be arbitrated in the order in which they were filed. This arbitration agreement shall survive the termination or expiration of these Terms and Conditions.

j. Governing Law; Forum Selection. These Terms and Conditions, and any action or contract to which they apply, shall be governed and interpreted by the laws of the State of Idaho and, where applicable, Title 49 of the United States Code, without reference to conflict of law principles. To the extent any claim is not subject to mandatory arbitration, all suits must be exclusively submitted to the jurisdiction of a state or federal court embracing Ada County, Idaho, to which the Parties irrevocably consent to personal jurisdiction and waive all objections thereto.

k. California Residents. Under California Civil Code § 1789.3, California consumers may file grievances and complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

14. Pick Up and Delivery Times; Delay

Web Auto Transport shall provide the Customer with an estimated pickup date and estimated delivery date. The Customer acknowledges and agrees that pick-up dates and delivery dates are estimates only, not guaranteed. Delays may occur prior to and/or during transport due to various issues including, without limitation, driver shortage, weather, and road conditions. Web Auto Transport does not guarantee any pickup or delivery times or dates. Web Auto Transport and Carrier are not liable for loss or damages occasioned by delays of any kind or for any reason, nor for car rental fees or accommodation fees due to delay in delivery.

15. Confidentiality

Pricing information, including any information contained in a written or oral quote, is confidential information between the parties and may not be disseminated to third parties without the express permission of the other party.

Customer shall not use Web Auto Transport’s name, logo, trademarks, or trade names in publicity releases, promotional material, customer lists, advertising, marketing, or business-generating efforts, whether written or oral, without obtaining Web Auto Transport’s prior written consent.

17. Undelivered Freight and Storage

(a) If freight cannot be delivered because of the Consignee’s refusal or inability to accept it, or because the Carrier cannot locate the Consignee, or if freight cannot be transported because of an error or omission on the part of the Consignor, the Carrier will make a diligent effort to notify the Consignor promptly that the freight is being stored and the reason therefor.

(b) Undelivered shipments will be placed in storage. Neither Web Auto Transport nor the Carrier has any liability for any storage fees. The Customer shall pay all storage fees prior to pickup of the Vehicle. In the event the Vehicle is re-delivered, the Customer is responsible for all accrued storage fees and freight charges for the re-delivery of the Vehicle.

18. Disputes and Collections

Any credit card dispute/chargeback, whether for services rendered or applicable cancellation fees, will be reviewed in accordance with these Terms and Conditions. If a dispute arises and is escalated to a collections agency, additional fees may be imposed. Web Auto Transport reserves the right to add a $300 fraudulent chargeback fee for any chargeback/credit card dispute submitted by the Customer/Cardholder where Web Auto Transport demonstrates the charge was valid and authorized.

19. Web Auto Transport Expedited Pickup Service

(a) Expedited Pickup Service: Web Auto Transport offers an Expedited Pickup Service guaranteeing vehicle pickup within the specified timeframe agreed upon at the time of booking.

(b) Eligibility: Available for select routes and vehicle types and not available for remote or rural locations and inoperable vehicles. Customers must explicitly opt for this premium service, which adds an additional cost to the original shipment price.

(c) Scheduling: Customers must provide accurate and complete pickup location, vehicle details, and preferred pickup date. Web Auto Transport will confirm the pickup details and provide an Expedited Pickup Date.

(d) Pickup Guarantee: Web Auto Transport guarantees to pick up the vehicle on the confirmed Expedited Pickup Date. In the rare event of inability due to unforeseen circumstances (e.g., severe weather, road closures, mechanical failures), Web Auto Transport will communicate promptly and reschedule at the earliest available opportunity.

(e) Customer Responsibilities: Vehicle must be prepared for transport and accessible at the agreed-upon time and location. Changes to pickup details must be communicated at least 48 hours prior to the Expedited Pickup Date.

(f) Exclusions: Does not cover delays caused by customer unavailability, inaccurate information, force majeure events, or circumstances beyond Web Auto Transport’s reasonable control.

20. Changes to Terms & Conditions

Web Auto Transport may modify these Terms and Conditions from time to time by posting the most up-to-date Terms and Conditions on https://webautotransport.com/terms-and-conditions. Such changes shall be effective for all transactions on the date of the notice/posting. Customer’s continued use of our services after any modification constitutes acceptance of the revised Terms.

21. Website Access

All ownership rights, intellectual property rights, and other proprietary rights relating to the Web Auto Transport website belong to Web Auto Transport. Subject to these Terms and the due payment of all applicable fees, Web Auto Transport grants Customer a limited, revocable, non-exclusive, non-transferable license to access and use the Web Auto Transport website solely for the purpose of obtaining transportation services. Any use of the website by any third party or for providing services to any third party is strictly prohibited.

WEB AUTO TRANSPORT DISCLAIMS ALL WARRANTIES OF ANY KIND WITH RESPECT TO THE WEBSITE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR TITLE. Web Auto Transport will not be liable for any indirect, direct, special, or consequential losses or damages, including loss of business or lost profits.

By checking the consent box on our website, you consent to receive communications from us electronically, such as e-mails, texts, ringless voicemails, mobile push notices, or broadcast notices, as set forth in our Privacy Policy.

(a) Opt-In: You may opt-in to receive SMS messages from Web Auto Transport by checking the consent box on our website at https://webautotransport.com.

(b) SMS Consent: By providing your consent to receive SMS communications, you acknowledge and agree to receive text messages from Web Auto Transport at the phone number you provide. You represent that you are the account holder or authorized user of the phone number provided and that you have authority to consent to receive text messages at such number. The information obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

(c) Types of SMS: Order updates, follow-up messages, billing inquiries, promotions or offers.

(d) Message Frequency: Message frequency may vary depending on communication type and your interactions with Web Auto Transport.

(e) Potential Fees: Standard message and data rates may apply depending on your carrier’s pricing plan.

(f) Opt-Out: You can opt out of receiving SMS messages at any time by replying “STOP” to any SMS message you receive, or by contacting us directly.

(g) Help: Reply “HELP” to any message or email info@webautotransport.com.

23. Miscellaneous

(a) Entire Agreement: These Terms and Conditions, along with the Order Confirmation and any other documents incorporated by reference, constitute the entire agreement between you and Web Auto Transport and supersede all prior communications and proposals, whether electronic, oral, or written.

(b) Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If any provision may be construed in two ways, one of which would render it illegal or unenforceable and the other valid, such provision shall have the meaning which renders it valid and enforceable.

(c) No Waiver: The failure of Web Auto Transport to enforce any right or provision of these Terms and Conditions will not be deemed a waiver of such right or provision.

(d) Assignment: You may not assign your rights or delegate your obligations under these Terms and Conditions without the prior written consent of Web Auto Transport. Web Auto Transport may assign its rights and delegate its obligations at any time without notice.

(e) Force Majeure: Web Auto Transport shall not be liable for any failure to perform its obligations where such failure results from any cause beyond Web Auto Transport’s reasonable control, including mechanical, electronic, or communications failure or degradation, acts of God, pandemic, governmental action, or labor disputes.

(f) B2B Non-Solicitation: This subsection applies exclusively to commercial customers (vehicle dealers, auction houses, fleet operators, and businesses) and not to individual consumer customers. Commercial customers agree not to directly solicit the services of any motor or freight carriers introduced by Web Auto Transport for a period of nine (9) months following the completion of the relevant shipment. Should a commercial customer breach this provision, Web Auto Transport shall be entitled to a commission equivalent to fifteen percent (15%) of the gross revenue generated from traffic assigned by such commercial customer to such carrier.

(g) Construction: Web Auto Transport and Customer acknowledge that they have each had the opportunity to review these Terms and seek the advice of legal counsel. No rule of construction requiring that ambiguities be resolved against the drafting party shall apply in interpreting this Agreement.
